Terms of Service

These Terms of Service ("Terms") govern your access to and use of QBuddy's AI-powered script rehearsal service (the "Service") at https://app.qbuddy.ai/.

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Operator

Until a legal entity is established, the Service is operated by the QBuddy founding team / individual operator ("Operator").

When we incorporate a legal entity, we will update these Terms to reflect the legal entity name and address.

2) Eligibility

You must be at least 16 years old (or the minimum legal age in your country) to use the Service. If you use the Service for an organization, you represent that you have authority to bind that organization.

3) Accounts and security

You are responsible for safeguarding your account and for all activity under it. You agree to provide accurate information and to notify us of unauthorized access.

4) The Service and AI limitations

QBuddy helps you rehearse scripts using automated and AI-assisted features.

AI output can be wrong, incomplete, or inconsistent. You are responsible for how you use the Service and any generated output. The Service is provided for rehearsal/creative purposes and does not provide professional advice.

5) Your Content

A) You keep ownership

You retain all rights to your scripts and other content you upload ("Content").

B) License to operate the Service

You grant the Operator a limited, non-exclusive, worldwide license to host, store, process, and display your Content solely to provide and improve the Service.

C) You confirm you have the rights

You represent and warrant that you own or have the necessary rights to upload and use the Content.

Important: Many scripts are copyrighted. Only upload scripts you own, have licensed, or are authorized to use.

6) Acceptable use

You agree not to:

  • Use the Service for illegal purposes or to infringe others' rights.
  • Upload malware or attempt to disrupt or access the Service improperly.
  • Reverse engineer or scrape the Service except where legally allowed.
  • Harass, threaten, or impersonate others.
  • Attempt to extract prompts, system instructions, or model internals via automated means.

We may suspend or terminate accounts for violations.

7) Third-party services

The Service may rely on third-party services (for example, hosting, AI processing, analytics). We are not responsible for third-party services outside our control.

8) Plans and payments (if applicable)

If paid plans are offered:

  • Pricing and features will be shown at purchase.
  • Subscriptions may auto-renew unless cancelled.
  • Taxes may apply.

Refund policy: no refunds except where required by law.

9) Beta / early access

The Service may be in an early-stage or beta state. Features may change or be removed, and the Service may experience downtime. The Service is provided "as is" and "as available".

10) Intellectual property

The Service (software, design, branding) is owned by the Operator and/or licensors and protected by IP laws. These Terms do not grant you ownership of QBuddy IP.

11) Termination

You may stop using the Service at any time.

We may suspend or terminate access if you violate these Terms, if required by law, or to protect the Service and other users.

12) Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available". We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13) Limitation of liability

To the fullest extent permitted by law, the Operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits/data.

The Operator's total liability for any claim relating to the Service will not exceed the amount you paid in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; in that case, the limitations apply to the maximum extent permitted.

14) Indemnity

You agree to indemnify and hold harmless the Operator from claims, damages, and expenses arising from your Content, misuse of the Service, or violation of these Terms.

15) Changes to the Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. If changes materially affect your rights, we will provide reasonable notice.

16) Governing law

These Terms are governed by the laws of Switzerland, excluding conflict of law rules, unless mandatory consumer protection rules require otherwise.
